Stock Up Africa provides premium financial information, insight sand analysis to the African Diaspora in general. Central to this mission is our commitment to upholding the highest standards of data protection for our customers. 

This Privacy Policy applies to all websites and web applications which link to this policy and are published by STOCK UP AFRICA LTD (“Sites”). 

If you wish to amend any of the personal information that we hold about you, or update your marketing preferences, you can do so at any time through your account.

Information we collect

This section details the information we may collect about you. We explain why, and how, we use it in later sections.

Account information

If you decide to create an account or enquire about one of our products or services, we’ll ask you to provide us with some specific information, for example:

  • Basic personal details - such as name, title and date of birth;

  • Personal contact details - such as home address, delivery address, home phone number, mobile phone number, and email address;

  • Work details - such as job title, department, company name, company address, work email address and office phone number;

  • Student or institution details, if you are signing up to a subscription of an educational establishment - such as student status, graduation year, establishment name;

  • Log in details - such as username and password;

  • Payment details - such as your bank account and payment card information.

We may also use your account information, such as your title, name and country, to infer your gender.

Additional information

On occasion, we will ask you to voluntarily provide additional information, for example:

  • Your opinion of our products and services;

  • Your preferences, including newsletters or STOCK UP AFRICA topics; 

  • Information such as your dietary preferences and accessibility requirements when attending an STOCK UP AFRICA event.

  • Information about your ethnicity and gender to support our diversity and inclusion goals.

Information we obtain from partners and public sources

In some circumstances, we collect information about you from our partners or from publicly available sources to help us better understand our audience and enhance the relevance of our content and marketing. For example, in some cases we obtain the contact details of potential speakers for STOCK UP AFRICA Live events from public websites. We also obtain some information from publicly available sources for the purpose of inclusion in our directories.

Information we obtain through cookies and similar tools

We use cookies (and similar technologies) and analytics tools across our Sites to collect information about you. This information can be used to improve the performance of the site, make advertising more relevant and enhance your user experience. We provide detailed information about cookies and similar technologies within our Cookie Policy; examples include:

  • Your location - we use cookies to display the version of the site that is most relevant to your location.

  • Your usage - we use cookies to understand how our customers use our Sites, and interact with our communications and journalism. For example, we use technology on our Sites which records user movements, including page scrolling, clicks and text entered. (It does not record payment details.) This helps us to identify usability issues and improve the assistance we can provide to users and is also used for aggregated and statistical reporting purposes.

  • Your device - we use cookies to understand what type of device you are using to show you the best version of the site.

  • Your engagement with advertisements - we use cookies to understand what advertisements you have been shown, or clicked on, to bill our advertising partners, and to present you with advertisements that are more relevant to you.

Lawful basis for processing

We only process personal information where we have a lawful basis for doing so, such as the following:

  • User consent
    This is where you have given us permission to process personal information for a given purpose. For example, if you complete one of our general enquiry forms, we would ask for your consent if we wanted to use your personal information for any other purpose. You have the right to withdraw this consent at any time. You can manage your preferences within your account or by contacting Customer Care.

  • Legitimate business purposes
    This is where we have a legitimate interest, as a business, to process personal information. For example, where we are aware of copyright infringements on our Site, it is in our legitimate interests as a business to identify those responsible. We take due care to balance our interests against your right to privacy.

  • Contractual necessity
    This is where we have to process personal information to meet our contractual obligations. For example, if you are a print subscriber, we would need to process your delivery address to fulfil your subscription.

  • Legal obligation
    This is where we have to process personal information in order to comply with the law. For example, we process and retain customer invoice information to comply with financial regulations.

We may also rely on relevant exemptions under the GDPR to the requirement to identify a lawful basis for processing.

How we use your personal information

We collect personal information for the following main reasons:

  1. To provide our service
    We require some of your basic personal information so our services work as you would expect, for example, delivering the newsletter to your correct email address, providing access to our digital content, notifying you of changes to our services and dealing with customer services queries. We record customer calls for monitoring and training purposes. Our Customer Care team may need to access your account to assist you with queries.

  2. To improve and maintain performance
    In order to provide you with the best possible user experience and value, we need to make sure that our products and services work as they should. Using personal information helps us understand how our readers experience our Sites and services, so we can make improvements. This includes contacting customers with market research surveys or for telephone interviews, hosting subscriber focus groups and analysing onsite data to test new and existing events, products and developments for STOCK UP AFRICA LTD. 

  3. To bill our customers
    We, along with our authorised payments processors, securely process your payment information to take payments, give refunds and to detect and prevent fraudulent activity. We will also update your payment information in the event that a payment is unsuccessful. You can manage your payment information at any time by contacting customer services. If your subscription is provided under a group subscription or trial, we will report information about your activity on our Site(s) for the purposes of billing.

  4. To monitor compliance with our policies and terms
    We monitor for breaches of our terms and conditions and copyright policies. For example, we reserve the right to inform the subscription holder if, through use of a group subscription, you are using our content in breach of the terms and conditions or copyright policies of our Sites. We also monitor activity on our Sites to detect and prevent invalid or fraudulent traffic.

  5. To personalise our products and services
    We improve your experience of our products and services by personalising parts of our Sites and apps with the information you give us and what we learn about you. This includes showing you articles you may be interested in and recommending emails you may wish to sign up to. Where our Sites have such functionality, you can manage elements of personalisation in your account.

  6. To communicate product changes and offers
    We want you to get the most out of our products and services, including showcasing our latest content and newsletters. We will contact you with carefully-curated STOCK UP AFRICA offers and promotions, exclusive event invitations and feature announcements. For example, if there are no updates on topics you follow, we will send you articles on other topics that we think you might be interested in. You are able to change your preferences at any time through your account or by contacting customer services.
    We also personalise our communications for strategic purposes. For example, we might offer group subscriptions to portfolio managers.

  7. For the purpose of advertising
    We rely on advertising revenue in part to support our award-winning journalism. We need to process your information to understand the effectiveness of the advertising we serve to you and others, and to deliver relevant personalised advertising. We use the information you give us, the information we collect about you, and the information we infer, to serve you with the most appropriate advertisements.
    You can manage your advertising settings for the Sites that carry out this activity in your account. If you do decide to turn off personalised advertisements or advertisements tailored to you, you will still see the same number of advertisements but they may be less relevant to you. You may continue to see advertisements that are targeted to you based on other non-personal information, for example, the article that you are reading.

  8. Recruitment - If you apply for a role via one of our Sites, we will process your information in order to facilitate the application process.

  9. To build directories - A number of our sites process personal information to create databases and directories. These directories provide key business insights and profiles to those that have licensed access. Where we make an individual’s contact details accessible in our directories, we inform the individual and provide instructions on how to have their contact details removed.

  10. To administer prize draws and competitions
    If you enter a prize draw or competition, we will process your information in order to run the competition or administer the prize draw. For example, we will process your address information if you are a winner and we need to send your prize by post. We may be required to publish or otherwise make available your name and/or region if you are selected as a winner in a competition or prize draw.

  11. For the purpose of diversity & inclusion initiatives
    We rely on information, such as gender, or inferred gender, and ethnicity to understand the composition of our audience and ensure that our products and services are engaging across our audience.

Who we share your personal information with

We disclose personal information to facilitate the running of our business or to provide specific services you have requested. Commonly, we will disclose information to:

  • Service providers
    We engage service providers who help to support our business and improve our products. These service providers include, for example, fulfilment providers for delivery of our digital content and marketing; customer service agencies; hosts, organisers and sponsors of our events; organisations that host our Sites, events or databases; and providers of online surveys. We also work with a number of distribution partners to deliver subscriptions. We have contracts in place with suppliers who process data to provide these services and they can only use your personal information under our instruction. For example, if you have a print subscription with us, we will disclose your information (address, contact details) to our distribution partners to facilitate delivery of the newsletter. 

  • Advertisers
    We, and our advertising partners, use cookies to collect personal information and serve you with advertisements that we believe are relevant to you and your interests. There is more specific information about our advertising partners and data sharing in our Cookie Policy.

  • Social media providers
    Information will be shared with social media platforms where you log in to our Sites via a social media account, or use components on our Sites provided by social media platforms (e.g. the “Facebook Recommend” function). We also share the information of our customers with social media partners for the following reasons:

    • To prevent existing subscribers from being targeted with subscription offerings on social media platforms;

    • For the purposes of targeted advertising on social media platforms, and to create lookalike audiences for these purposes;

  • Other users
    Our Sites are publicly accessible and anyone around the world who accesses our Sites will be able to see anything you post, such as comments about an article. We encourage you to use a pseudonym when commenting on our Sites if you do not wish to be identifiable to other readers.

  • STOCK UP AFRICA LTD
    We share your information with other companies within the STOCK UP AFRICA group to provide our services and to better understand the relationship between our products.. Sometimes services are provided between legal entities in the STOCK UP AFRICA group, which may involve the processing of personal data by one entity on behalf of another. For example, we may share publicly available personal data in our directories.

  • Legal processes and successors in title
    We, and our suppliers, may also disclose your information to comply with applicable laws, court orders or other valid legal processes, and to enforce or apply our terms of use, any subscription agreement, or any of our other rights.
    We may transfer or disclose your personal information to any entity which takes over or acquires  STOCK UP AFRICA LTD.

We also share aggregated, non-identifiable information with third parties. Before sharing this information, we ensure that it cannot identify you as an individual. For example, we regularly release information about the size and growth of our audiences.

How long we retain your personal information

We retain the majority of your personal information for as long as your account is active and therefore open; this allows you to continue accessing our content, products and services.

If you become inactive and are not a subscriber, we may delete elements of the information associated with your account. We will normally warn you if your access is going to be withdrawn and give you the opportunity to retain your account. 

Where we don’t need to keep all of your information in full, we will obfuscate or aggregate it, for example, web activity logs and survey responses. This is to ensure that we do not retain your information for any longer than is necessary.

How we keep your personal information secure

We have appropriate technical and administrative security measures in place to help ensure that our users’ information is protected against unauthorised or accidental access, use,  alteration, or loss. To demonstrate our commitment to security, we have achieved the UK Cyber Essentials Plus accreditation. We use encryption technology, to protect your personal information when you order products or services from us. We operate a global business, so your personal information may be processed and stored outside the UK and the European Economic Area (EEA). For example, our global customer services team need to access information about you in order to respond to your queries. We put in place safeguards, such as standard contractual clauses, to protect information that is transferred in this way.  

Your rights

Under data protection laws, you may have rights as an individual in relation to the personal data  we hold about you. These rights include:

  • The right to object to direct marketing - your preferences, including in relation to direct marketing, can be found in your account;

  • The right to access the personal data that we process about you;

  • The right to request the deletion of your personal data;

  • The right to request the rectification of your personal data - you can manage some of this information in your account.

You can exercise these rights through your account or by contacting Customer Care.

You also have the right to lodge a complaint with a supervisory authority. In the UK, this is the Information Commissioner’s Office (ICO).

Where this Privacy Policy applies

Personal information is collected by Stock Up Africa Limited.

Our Sites are not intended for children under 16 years of age. We do not intentionally collect or use any information from children.

Our Sites contain links to third party websites which are not subject to this privacy policy. We are not responsible for their content, use of personal information, or security practices.

Privacy notice for California Consumer Privacy Act

This section is intended for California residents and supplements the above. 

Rights for California residents

If you are a California resident, the California Consumer Privacy Act (CCPA) may provide you with additional rights regarding the use of your personal information. These rights include:

  • The right to know what personal information is collected about you and if any information is sold or disclosed, and to whom;

  • The right to request the deletion of your personal information, if applicable;

Our Advertising

If you are a California resident, the CCPA also provides you with a right to opt-out of the sale of your personal information. The definition of sale is extremely broad under the CCPA, and may include sharing certain pieces of information with our advertising partners, such as cookie identifiers, geolocation and interactions with advertisements, for the purposes of showing you advertising that is relevant to your interests. 

You can choose to block sharing of this data with advertisers. This means that we turn off  some types of advertising based on information you have given us and your use of our Sites, ensuring that our advertising partners do not receive this data. By opting out, you will stop receiving adverts that are targeted specifically to you; however, you will still see the same number of adverts on our Sites.

1. About our Terms

1.1. We are Stock Up Africa (""we", "us", or "our"), a limited company registered in England and Wales and our registered address is Bracken House, 1 Friday Street, London, England, EC4M 9BT. Our company number is 00227590, our UK VAT registration number is………………..and our data protection registration number is……..

1.2. These Terms and Conditions apply whenever you:

  • use Stockupafrica.com, Stockupafrica.com mobile and online digital apps and services (together “Stockupafrica.com”) and access the content and services available on them including the Stock Up Africa newsletter (together, the “STOCK UP AFRICA Content”); and

  • purchase access to Stockupafrica.com, the Newsletter and/or the STOCK UP AFRICA Content (together, the "STOCK UP AFRICA Services") on a subscription basis.

1.3. You should read these Terms and Conditions carefully before using Stockupafrica.com and/or STOCK UP AFRICA Content or subscribing to the STOCK UP AFRICA Services. By accessing, using or subscribing to any of the above, you agree to be bound by these Terms and Conditions (as applicable) and the documents referred to in them.

1.4. If you access Stockupafrica.com under an organisation’s subscription agreement, then your access is primarily governed by the subscription agreement between us and that organisation. In the event of any conflict between these Terms and Conditions and the organisation's subscription agreement (as applicable), the terms of the organisation's subscription agreement shall prevail to the extent of the inconsistency only. 2. Your Subscription to the STOCK UP AFRICA Services

Subscribing to the STOCK UP AFRICA

2.1. We offer a range of subscriptions: 

  • to Stockupafrica.com (“Digital Subscriptions”);

  • the Newspaper (“Print Subscriptions”),

  • to both Stockupafrica.com and the Newspaper (“Bundled Subscriptions”); and 

  • we also offer subscriptions on a trial basis ("Trial Subscriptions")

The above are referred together as "the Subscriptions" and individually as a "Subscription". Please note that separate and/or additional terms and conditions may apply to any Trial Subscriptions that we may offer. Any such additional terms shall be clearly indicated. 

2.2. You may not take more than one Trial Subscription in any twelve-month period.  We may cancel any Trial Subscription that you may have purchased, without refund, if you have had access to any other Trial Subscription in the previous twelve months.

2.3. You may purchase a Subscription by submitting an order and providing the sign up details on Stockupafrica.com, by phone, email, using our Live Chat on Stockupafrica.com or by letter. We will only accept your order when we have successfully verified your email address, processed your payment details and emailed you to confirm this.

2.4. We will try to process your Subscription order promptly but cannot guarantee activation by any specified time. We may reject any Subscription order in our discretion. You confirm that your sign up and payment details are complete and accurate, and that you are entitled to purchase a Subscription using those sign up and payment details. Each Subscription is for a single user only. We may cancel or suspend your Subscription account if you share your access rights with any third parties, or attempt to allow third parties to avoid our control of access to Stockupafrica.com. 

Fees and Payment

2.5. You agree to pay the Subscription fees at the rates and in the currency displayed during the Subscription process.  Prices may vary from time to time and by country, and Subscriptions may be available on a one-off, monthly, annual or other basis.  Discount offers are as stated at the time you subscribe and cannot be changed during the term of your subscription. Unless otherwise indicated, prices stated are inclusive of any applicable value added tax (VAT) or other sales taxes. The breakdown of any VAT will be indicated on the relevant invoice.

2.6. If we do not receive payment authorisation or any authorisation is subsequently cancelled, we may immediately terminate or suspend your Subscription. 

2.7. If you take a Trial Subscription, we will inform you of the full Subscription price payable at the start of the trial period. Your Subscription will renew automatically at the end of that trial period at the full Subscription price unless you cancel your Subscription before the end of the trial period.

2.8. We will give you at least 14 days’ notice of any increase in the price of your Subscription, which will take effect at your next renewal date.

2.9. If we incorrectly state a price online or otherwise, we are not obliged to provide you with a Subscription at that price, even if we have mistakenly accepted your offer to buy a Subscription.  If we notify you of a pricing error, you may cancel the Subscription and we will refund you any money paid, or you may pay the correct price. If you do neither, we may cancel your Subscription and refund any money you have paid. We will always act in good faith in determining whether a genuine pricing error has occurred.

2.10. If you are entitled to a refund we will credit that refund to the card or other payment method you used to submit payment, unless it has expired in which case we will contact you to arrange.

2.11. In addition to the Subscription fees you are responsible for paying for any:

  • broadband, mobile, data, messaging or other internet connection and telecommunications charges that you may incur by accessing STOCK UP AFRICA Content; 

  • charges that may be levied by your bank or credit card issuer (for example foreign transaction fees on transactions which take place abroad or in a foreign currency).

2.12. We will do all that we reasonably can to ensure that all of the information you give us when paying is secure by using an encrypted secure payment mechanism. However, in the absence of negligence on our part, any failure by us to comply with this contract or our Privacy Policy or breach by us of our duties under applicable laws, we will not be legally responsible to you for any loss that you may suffer if a third party gains unauthorised access to any information that you give us.

Home Delivery

2.13. We will deliver your Newspaper from Monday through to Saturday to the address you provided during the sign-up process if it is within our delivery areas. We do not guarantee delivery to non-secure locations or beyond ground floor levels.  Any special delivery requests may be printed on your Newspaper and seen by third parties, and we cannot guarantee that these requests will be fulfilled.

2.14. We aim to commence delivery of your Newspaper within 2 business days (UK), 7-10 business days (Eurozone) or 10-12 business days (United States) of your Subscription commencing.  Delivery times for other regions will be confirmed separately. 

2.15. If you do not receive your Newspaper on the expected delivery date, please contact us within 7 days and we may arrange an extension or credit for that delivery (excluding Trial Subscriptions of 4 weeks or fewer).

2.16. If you wish to change your address for home delivery then please contact us at least 10 days' before the date on which you wish your change of address to take effect. If we are not able to provide you with a home delivery service to your new address then:

  • If you have a Print Subscription we will cancel your Subscription and issue a pro rata refund for the unexpired period of your Subscription; and 

  • If you have a Bundled Subscription we will cancel your Subscription, issue a pro rata refund for the unexpired period of your Subscription and, at your option, transfer you onto a new Digital Subscription. 

Paper or Digital Vouchers

2.17. You may only redeem vouchers for Newspapers (subject to availability) at participating UK retailers on the date shown on the voucher, except STOCK UP AFRICA Weekend which is also valid on the Sunday of the same weekend.  Vouchers cannot be exchanged for cash or any other products. You must not copy, resell or transfer vouchers to anyone else.  

2.18. Paper vouchers will be posted and digital vouchers will be emailed using the information you provided during the sign-up process. 

2.19. If your Subscription has been cancelled, vouchers will no longer be valid and you must promptly post any unused paper voucher packs to the address printed on the back of the pack.  We may provide a refund for any vouchers that relate to the remainder of a Subscription period you have already paid for, and we reserve the right to charge you for any voucher packs that have not been returned which relate to a period for which you have not yet paid. Paper and digital voucher subscriptions cannot be suspended by you at any time. 

Your Cancellation Rights

2.20. Digital Subscriptions:

  • By placing your order for a Digital Subscription subject to these Terms and Conditions, you agree that we may start your Subscription immediately upon our acceptance of your order and that you waive your statutory right to cancel our contract within 14 days of our confirmation email. 

  • This means that you lose your right to cancel this contract once we have provided confirmation via email of your Digital Subscription (see section 2.3 above) and that any notice of cancellation that you provide (whether before or aStock Up Africaer the 14-day period) will only take effect at the end of your current subscription period. You will not be entitled to a refund except in the event that there is a fault in our provision of our STOCK UP AFRICA Services. 

2.22. To exercise the above rights to cancel, you must inform us of your decision to cancel the contract by using our online chat feature, calling us on your regional telephone number, or emailling us at info@stockupafrica.com with the following: "I/We hereby give notice that I/we cancel my/our subscription". Please then include:

  • the subscriber's full name (person on the billing information if different from the user);

  • the Account email address or Account Number (Customer Reference Number);

  • the billing address and delivery address (Including zip code/postcode); and

  • your contact telephone number.

Our Cancellation Rights

2.23. We may suspend or terminate your Subscription if we are prevented from providing services to you, or accepting payment from you, by applicable law or circumstances beyond our control, or if we cease publishing the Newspaper or Stockupafrica.com or STOCK UP AFRICA Services. If we terminate for any of these reasons, we will provide you with a pro rata refund to the extent permitted by applicable law.

2.24. We may also suspend or terminate your Subscription, without refund, if you breach these Terms and Conditions, or in the event of any verbal or written abuse of any kind (including abusive, offensive or aggressive language) directed towards our Customer Care team, other STOCK UP AFRICA personnel, or any member of the public, with or without notice and without further obligation to you. 

2.25. If you are not a Subscriber, then we may suspend or terminate your access to the STOCK UP AFRICA Content at any time, with or without notice and without further obligation to you.

Effects of cancellation

2.26. If you are entitled to a refund, we will make the reimbursement without undue delay, and not later than 14 days aStock Up Africaer the day on which we are informed about your decision to cancel your Subscription.

2.27. We will make the reimbursement using your registered payment details. Additional charges may apply if we are required to reimburse to any other credit card or bank. 

2.28. If you have received copies of the Newspaper as part of your Subscription, you will not be expected to return these copies, but we will retain payment for such in accordance with these Terms and Conditions.

2.29. If you access the STOCK UP AFRICA Services by exchanging the Newspaper for voucher packs which are issued by us, we reserve the right to charge you the subscription fee for the renewal period if we have sent you voucher packs that have not been returned before your subscription start date. We will provide you with a refund of the subscription fee on receipt of the complete returned voucher pack.

Renewals

2.30. Unless you notify us at least 14 days before the end of your current subscription period that you wish to cancel, your subscription will continue to renew for further equivalent periods and will be subject to these Terms and Conditions. We will charge the subscription using the same card or other payment method that you previously used. In the case of annual subscriptions, we will send you a reminder notice at least 14 days before the renewal date stating the rate that will apply for the renewal period. 

3. Using Stockupafrica.com

Ownership of Stockupafrica.com and STOCK UP AFRICA Content

3.1. Stockupafrica.com and STOCK UP AFRICA Content and all intellectual property rights in each are owned by us, our licensors or both (as applicable). Intellectual property rights means rights such as: copyright, trade marks, domain names, design rights, database rights, patents and all other intellectual property rights of any kind whether or not they are registered or unregistered (anywhere in the world). We reserve all of our rights in any intellectual property in connection with these Terms and Conditions. This means, for example, that we remain owners of them and free to use them as we see fit.

3.2. Nothing in these Terms and Conditions grants you any legal rights in Stockupafrica.com or the STOCK UP AFRICA Content other than as necessary to enable you to access Stockupafrica.com and use the STOCK UP AFRICA Services. You agree not to adjust, to try to circumvent or delete any notices contained on Stockupafrica.com (including any intellectual property notices) and in particular in any digital rights or other security technology embedded or contained within Stockupafrica.com.

3.3. "STOCK UP AFRICA" is a registered trade marks and you may not use them without written permission from STOCK UP AFRICA LTD. You are permitted to use the STOCK UP AFRICA Content only as set out in our Terms & Conditions.

Accessing and using STOCK UP AFRICA Content 

3.4. You agree to comply with our Terms & Conditions when using STOCK UP AFRICA Content. You are responsible for all use of STOCK UP AFRICA Content whether accessed without a Subscription as a registered user, under your Subscription, or under your organisation’s Subscription.

3.5. To the fullest extent permitted by law, we expressly prohibit any use of our content or data (including any associated metadata) in any manner for any machine learning and/or artificial intelligence purposes, including without limitation for the purposes of training or development of artificial intelligence technologies or tools or machine learning language models, or otherwise for the purposes of using or in connection with the use of such technologies, tools or models to generate any data or content and/or to synthesise or combine with any other data or content. We reserve all rights to license any use of our content and data for any such purposes.

3.6. The amount and types of STOCK UP AFRICA Content that you can view depend on what type of subscription you have. We may vary or cancel the access rights of non-paying users at any time.  

3.7. Your access to STOCK UP AFRICA Content will vary depending on whether you have a STOCK UP AFRICA Standard or STOCK UP AFRICA Premium Digital Subscription. An STOCK UP AFRICA Standard Subscription provides an overview of the most important business, political and economic stories from around the Africa whereas an STOCK UP AFRICA Premium Subscription gives readers full access to STOCK UP AFRICA events, including exclusive additional analysis and insight. 

3.8. We reserve the right to amend the scope of your Digital Subscription from time to time. We will give you at least 30 days’ notice of any significant reduction in the scope of your Digital Subscription, and these will only take effect from the date of your next payment following that 30-day period. This does not apply where a type of content or service intended for STOCK UP AFRICA Premium subscriptions is made available to STOCK UP AFRICA Standard subscribers on an introductory, temporary or trial basis. 

3.9. On registration, you will choose a user name and password (“ID”). It is your responsibility to keep your ID confidential. The email address must not correspond to a generic or shared email account, and you must be entitled to use that e-mail address.  All information received by us from your use of STOCK UP AFRICA Content will be used by STOCK UP AFRICA in accordance with our Privacy Policy.

3.10. If you believe there has been any breach of security such as the disclosure, unauthorised use of your ID or any payment information, you must notify STOCK UP AFRICA immediately by e-mailing us at info@stockupafrica.com.

User Generated Content

3.11. Stockupafrica.com includes comments sections, blogs and other features that allow interaction between users and between users and STOCK UP AFRICA journalists (“Forums”). You are responsible for all the content of any of your UGC that you or we publish. You are financially responsible to us for any claim against us by any third party that your UGC is not in accordance with these Terms and Conditions or that otherwise relates to your UGC.

3.12. You own the copyright in your UGC, and you agree to grant STOCK UP AFRICA a right (but not an obligation) unlimited in time to publish, re-use, archive, modify, delete or commercially exploit that UGC in whole or in part as we see fit, whether on Stockupafrica.com or otherwise, without any requirement to pay you for this and with or without attribution to you. You also waive any moral rights that you may have in regard to the UGC.

3.13. You agree that you will:

  • only post original content and not infringe the copyright or other rights of any third party;

  • not post any UGC containing any form of advertising or promotion for goods and services or any form of unsolicited communication;

  • not post any confidential information of a third party;

  • not post any recommendations to buy or not buy a particular share or investment or which otherwise has the purpose of affecting the price or value of any share or other investment;

  • not post anything that is threatening, offensive, libellous, indecent or unlawful;

  • not post anything that is discriminatory in nature, for example, comments which make attacks on the grounds of race, religion, sex, gender, sexual orientation, disability or age;

  • respectfully challenge different points of view but not personally attack other commentators.

  • not disguise the origin of any UGC and not impersonate any person or entity (including STOCK UP AFRICA employees or Forum guests or hosts) or misrepresent any connection with any person or entity;

  • not post any UGC unrelated to the Forum or the Forum’s topic;

  • not post any UGC that contains viruses, files or code designed to interrupt, destroy or limit the functionality of Stockupafrica.com or any computer software or equipment;

  • not collect or store other users’ personal data;

  • not restrict or inhibit any other user from using the Forums; and

3.14. It is not possible for STOCK UP AFRICA to fully monitor all UGC published on Stockupafrica.com but where we have actually received notice of any UGC that is potentially misleading, untrue, offensive, unlawful, infringes third party rights or is potentially in breach of these Terms and Conditions, then we will review that UGC, decide whether to remove it from Stockupafrica.com and act accordingly. This may include banning a user from participation in UGC on Stockupafrica.com. If you are aware of any such UGC, please notify us immediately with specific details by contacting us at help@stockupafrica.com.

3.15. We can link your UGC, including anything posted under a pseudonym, to your Stockupafrica.com account. Our moderation and community team may contact you from time to time regarding your UGC.

Accuracy of information and availability of Stockupafrica.com

3.16. While we try to make sure that Stockupafrica.com and all STOCK UP AFRICA Content is accurate, up-to-date and free from bugs, we cannot promise that it will be. Furthermore, we cannot promise that Stockupafrica.com will be fit or suitable for any purpose. Any reliance that you may place on the information on Stockupafrica.com is at your own risk.

3.17. STOCK UP AFRICA Content is provided for your general information purposes only and to inform you about us and our products and news, features, services and other websites that may be of interest. It does not constitute technical, financial or legal advice or any other type of advice and should not be relied on for any purposes.

3.19. We may suspend or terminate operation of Stockupafrica.com or any part thereof at any time as we see fit.

3.20. While we try to make sure that Stockupafrica.com is available for your use, we do not promise that Stockupafrica.com is available at all times nor do we promise the uninterrupted use by you of Stockupafrica.com.

Third party sites and products

3.21. Stockupafrica.com may contain hyperlinks or references to third party websites and third party products. Any such hyperlinks or references are provided for your convenience only. We have no control over third party websites and accept no legal responsibility for any products, content, material or information contained in them. The display of any hyperlink and reference to any third party website or third party product (including any advert or sponsor) does not mean that we endorse that third party's website, products or services. Your use of a third party site may be governed by the terms and conditions of that third party site.

3.22. Any agreements, transactions or other arrangements made between you and any third party named on (or linked to/from) Stockupafrica.com are at your own responsibility and entered into at your own risk.

4. Your Privacy and Personal Information

4.1. Your privacy and personal information are important to us. Any personal information that you provide to us will be dealt with in line with our Privacy Policy, which explains what personal information we collect from you, how and why we collect, store, use and share such information, your rights in relation to your personal information and how to contact us and supervisory authorities in the event you have a query or complaint about the use of your personal information.

5. Limitation on our Liability

5.1. STOCK UP AFRICA makes no warranty, express or implied, regarding your Subscription, Stockupafrica.com, STOCK UP AFRICA Content or STOCK UP AFRICA Services, which are provided 'as is'. We expressly disclaim all warranties to the extent permitted by law, including but not limited to warranties of fitness for a particular purpose.

5.2. Except for any legal responsibility that we cannot limit or exclude in law (such as for death or personal injury), in the event that you suffer any losses arising in connection with your Subscription, or your use of Stockupafrica.com, STOCK UP AFRICA Content or STOCK UP AFRICA Services:
(a)  our total liability to you shall not exceed the total sums paid by you for your current Subscription; and 
(b)  we shall not be liable or legally responsible in any way (whether in contract, tort (including negligence) or otherwise) for:
               (i) any loss that was not foreseeable to you or the STOCK UP AFRICA when the contract was formed;
               (ii) any loss that was not caused by any breach on STOCK UP AFRICA’s part;
               (iii) any business loss (including business interruption, or loss of revenues, sales or business opportunity);
               (iv) any loss of profits, anticipated savings, goodwill, reputation, or data;
               (v) any loss of use or corruption of software or technical equipment;
               (vi) any loss to non-consumers; and
               (vii) any indirect or consequential loss
in each case even if we have been advised that such damages may arise.

5.3. The limitations of liability in this section 5 apply for the benefit of STOCK UP AFRICA, its affiliates, including those listed in section 6 and all of their respective officers, directors, employees, agents or any company who we transfer our rights and obligations to in accordance with these terms and conditions.

7. Changes to these Terms and Conditions

7.1. These Terms and Conditions were published on 31 May 2023 and replace with immediate effect the Terms and Conditions previously published on 1 March 2022.

7.2. We may update these Terms and Conditions for legal or regulatory reasons, or to reflect changes in our services or business practices. We will provide notice of any significant changes below. You should regularly check this section to see if any changes have been made. If you are a paying subscriber, any changes to our terms and conditions will become effective from the date of your next payment following the change unless we notify you otherwise. If you are not a paying subscriber, any changes will become effective as soon as we post them on Stockupafrica.com.

8. Law and Jurisdiction

8.1. If you are a user whose principal address or principal use of Stockupafrica.com occurs in any jurisdiction other than the United States then these Terms and Conditions will be subject to English law. In this case, to the extent possible in the applicable jurisdiction, both you and we agree that the courts of England will (subject to the final paragraph in this section 8) have non-exclusive jurisdiction to settle any dispute which may arise out of, under, or in connection with these Terms and Conditions.

9. General

9.1. We shall have no liability to you for any breach of these Terms and Conditions caused by any event or circumstance beyond our reasonable control including, but not limited to, strikes, lock-outs or other industrial disputes; epidemic or pandemic; breakdown of systems or network access; or flood, fire, explosion or accident.

9.2. You may not license or transfer any of your rights under these Terms and Conditions. We may transfer any of our rights or obligations under these Terms and Conditions to any company within Stock Up Africa LTD, but if we do so we will ensure that any company to whom we transfer our rights or obligations will continue to honour your rights under them.

9.3. If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms and Conditions, which will remain in full force and effect.

9.4. Failure by either party to exercise any right or remedy under these Terms and Conditions does not constitute a waiver of that right or remedy. Headings in these Terms and Conditions are for convenience only and will have no legal meaning or effect.

9.5. These Terms and Conditions (together with the documents referred to within these Terms and Conditions including in sections 1.4 and 2.1) constitute the entire agreement between you and the STOCK UP AFRICA relating to your use of the STOCK UP AFRICA Services. They supersede all previous communications, representations and arrangements, either written or oral.

9.6. . Any payment information you send to us over the Internet is encrypted using 128 bit Secure Socket Layer technology. SSL is currently the preferred method to securely transfer credit card data over the Internet.
